In these cases, it is so hard to determine if the people posting "threats" are serious with a means to carry them out, or if it is just a teen blowing off steam. I do think it needs investigated.

what isnt making sense is the superident said that no disiplinary action was taken but isnt the one girl that is being questioned out of school and all of the others involved are still attending school?

hey if it makes no sense, it probably isn't good sense. call the super up & question him if he doesn't have an answer, ask him why he doesn't. maybe it is time for this super to go. man,
look at what has happened under his watch. 2 schools to rule over & it doesn't seem like we are getting much for our money.
oh, i know the new school building & location will solve all the problems. you will be so busy scraping the money up to pay your taxes, you won't have time to worry about what is going on at the 2 schools.problem solved...

How difficult is it to obtain records from myspace, doesn't a court order cost money and is time consuming? Attorney Marc Dann just found that out.

generally these sites have automatic returns for records for police investigation of criminal activity (because it's a crime not to cooperate.) If you're a private person or non-criminal investigation then you'll have to subpoena (that would be a "court order.") The myspace folks don't typically have to play ball with these private requests (yahoo does, irs doesn't) and can obfuscate/ side step the situation with little effort.

The question I have, what does off campus threats have to do with the school activities and how/why is this girl missing school? Is she expelled? Was there a hearing? I believe that the federal courts have held that off campus behaviour can not be used to punish a child in school (this holds true for both private and public schools.)

Federal appellate courts have been very clear in these matters, hopefully some lawyer (whose not busy chasing ambulances) can point to the findlaw for this. I'm sure that GSD has better things to track. However, I bet the Girard mom can not put together enough words to make a cogent sentence to save her daughter.

Eighth Grade Girl Who Created Satiric MySpace.com Profile Is Reinstated
HOLLAND, OH -- The American Civil Liberties Union of Ohio today applauded a decision by the Springfield School Board to reinstate eighth-grade student Jessica Schoch. Schoch was not allowed to attend school or participate in extracurricular activities after school officials discovered a MySpace.com profile that parodied a school administrator.

“We are pleased the school board ultimately recognized that defending a lawsuit over its actions would have been time-consuming, costly to taxpayers and most importantly -- unsuccessful,” said ACLU of Ohio cooperating attorney Arnold Gottlieb.

Strange in that statements don't match.

>Superintendent Joseph Jeswald said no student has been suspended or faced
>disciplinary action as a result of the Web page.

>Theresa Herrick, however, said her 15-year-old daughter, a freshman at Girard
>High School, has been out of school since Monday with no promise that she will
> be able to return before the school year ends Thursday.

These statements don't match. Either the Superintendent is lying or Vindy reporter got the story wrong, nonetheless, this story is yet another poorly written piece: lacking key details, specifics, elaboration on discrepancies and most likely accuracy. Who is telling this Mohter Theresa her daughter can not go to school?

More Jerry Springer stupid @#$%& in Girard.

Someone at the school said the daughter can not attend. The school is now tutoring her since all the media attention.Does not make sense that Jeswald said that because it is not the truth.Heard no formal process was followed,no paperwork, just booted out.

That's right, It's just kids blowing off steam! But did you see what escalated from a MYSPACE posting in Y-town? Oh that's right this is Girard, nothing like that could ever happen there.
